COURSE SUMMARY

This Course is aimed at personnel who need an understanding of Contract Law within Construction.

This Course Covers the following topics:

  •  Instructions & Variations – processes & terminology under JCT (and NEC); base date; practical implications of verbal instructions; valuation methods; fluctuations; dispute avoidance tips/records & housekeeping.
  • Payment – processes & terminology under JCT and NEC; interim valuations; final account; fair valuation; retention rules; materials off site; dispute avoidance tips/records & housekeeping.
  • Schedules of Amendment – what they contain & achieve & why; key points of negotiation & risk management strategies.
  • Practical Completion - processes & terminology under JCT (and NEC); partial possession; beneficial use; rectification periods; examples of patent defects; retention release; dispute avoidance tips/records & housekeeping.
  • Delays and Extensions of time – processes & terminology under JCT (and NEC); liquidated vs unliquidated damages; practical implications when applied to progress reports & target programs; options when EOT applications are ignored/denied; dispute avoidance tips/records & housekeeping.
  • (Sub)contract Terms & Conditions – what they (should) contain & achieve & why; key points of negotiation & risk management strategies.

Upon Successful Completion candidates are issued with an in-house certificate.
