This Course is aimed at personnel who need an understanding of Contract Law within Construction.
This Course Covers the following topics:
- Legal Issues in Construction - Exploring the meaning, implications and key options for tackling of some of the legal terms most commonly encountered in the construction industry e.g. execution, consideration, novation, assignment, collateral warranties, third party rights, ‘back-to-back’, indemnity, liability, framework, call off, procurement, construction management, design & build etc.
- Adjudication & Dispute Avoidance - The structure of an adjudication & how the effectiveness of the record keeping/housekeeping practices protect the business i.e. what the lawyers need from clients (when a difference of opinion is escalating into a dispute) in order to get the desired outcome for the contractor. Importance of record keeping, site diary, labour returns, weather records etc.
- Letters of Intent - What they contain & achieve & why; key points of negotiation & risk management strategies.
- Supplier Terms - Typical terms & conditions of order; rights & remedies for default.
Upon Successful Completion candidates are issued with an in-house certificate.
